Pennsylvania Suspends 2% Biodiesel Content Mandate Until Midnight

The Pennsylvania Petroleum Association just received a copy of a letter from state Acting Department of Agriculture Secretary Russell Redding notifying Gov. Tom Wolf on Monday March 2 that he is partially suspending the state mandate for 2 percent biodiesel, as authorized under the state’s Biofuel Development and In-State Production Incentive Act, because a shortage exists.

As of Monday, March 2, 2015 and expiring at 11:59 p.m. Wednesday, March 4, 2015, the requirement for 2 percent biodiesel fuel is suspended under the following terms–

— All retailers, as defined in the (Biofuel) Act, who take delivery of diesel fuel during the period of suspension blended outside the Commonwealth which is not compliant with the 2 percent biodiesel mandate may sell such diesel fuel to consumers during the period of suspension. Such diesel fuel delivered during the period of suspension may be sold to consumers after the suspension expires until all such delivered diesel fuel is out of the retailer’s possession. Any new deliveries to a retailer after the suspension expires will be subject to all provisions of the Act.

Acting Secretary Redding said his agency will continue to monitor conditions and should conditions warrant, this suspension may be modified, terminated or extended as appropriate.

Please note that PPA did not ask for this suspension and was not informed until late this afternoon.
