Industry Groups Announce Intent to File Brief in Support of Speculative Position Limits

The Commodity Markets Oversight Coalition filed a Motion for Leave to Participate as Amicus Curiae with the U.S. Court of Appeals for the District of Columbia on the case regarding speculative position limits for commodities (International Swaps & Derivatives Association, et al v. Commodity Futures Trading Commission, No. 12-5362).


 


The document announces the coalition’s intent to file an amicus curiae brief and requests the court’s approval to file a separate brief in support of the CFTC. We are confident the court will respond favorably to our request. The document also provides the court with a preliminary list of organizations supporting our brief. This list continues to grow and we will provide a full list to the court upon the filing of our brief.


 


The original filing deadline for the brief was March 28th but the Court recently suspended the briefing schedule. We expect briefs will now be due sometime in April.
