NPGA, NYPGA, Mulhern Gas Sue Over NY Gas Ban

A coalition led by the National Propane Gas Association, the New York Propane Gas Association and Mulhern Gas filed a lawsuit ​in federal court, Albany today against the gas ban in the All-Electric Buildings Act.

The suit alleges that New York State has violated federal law by passing a ban on gas equipment and infrastructure in some new buildings starting December 31, 2025. The ban is illegal based on the federal Energy Policy and Conservation Act (EPCA), a longstanding federal law establishing a national energy policy. Its goal: a nationally uniform energy use and efficiency standard to promote conservation goals while ensuring energy security and domestic supply. To put it simply: New York’s ban flouts the plain language and purpose of the law.

The plaintiffs in the lawsuit are: Mulhern Gas, Holmes Mechanical, New York Propane Gas Association, National Propane Gas Association, New York Homebuilders Association, National Homebuilders Association, Northeast Hearth Patio BBQ Association, Long Island Plumbers Association, Master Plumbers Council of New York City, International Brotherhood of Electrical Workers Local 1049, International Brotherhood of Electrical Workers Local 97, Plumbers Local Union # 200, Transport Workers Union Local 101.
